However, if the work is created by an employee within the scope of his employment, the employer owns the copyright under the "work for hire" rule. Other scenarios may also fall under the "work for hire" rule. If a work has been specially commissioned, it is a "work for hire" if the creator signs a written agreement stating that the commissioned work is a "work for hire" prior to commencing development of the work. Given the importance of work-for-hire rights, an agreement should be executed at the commencement of the employment or the assignment (of specially commissioned works) clarifying ownership rights, in advance. |
